When a disability plan is governed by ERISA:
- You have 180 days to file an appeal with your insurance company when you have been denied disability coverage. This can be helpful in that it allows you time to contact a denied disability claims attorney, and it allows us time to develop a strong case for appeal. Unfortunately, it also leaves you out of income for six months.
- When you actually file the appeal, the insurance company has 45 days — but sometimes 90 days — to make a decision. This increases your time without the disability benefits you were counting on to nine months or more.
